Welcome to America Virtual Care, a virtual primary and urgent care service. By accessing and using our services, you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully.

1. Acceptance of Terms

By using the America Virtual Care website, mobile application, and virtual healthcare services, you acknowledge that you have read, understood, and agree to these Terms and Conditions. If you do not agree with these terms, please refrain from using our services.

2. Services Provided

America Virtual Care offers virtual healthcare services, including primary care, urgent care, prescription refills, Chronic disease management, and more. These services are provided by licensed healthcare professionals who will assess, diagnose, and treat patients based on the information provided during the virtual consultations.

3. Eligibility

To use our services, you must be at least 18 years old or have parental consent if you are a minor. You must also provide accurate, complete, and current information about yourself, including medical history, when accessing our services. Misrepresentation of information may result in termination of services. America Virtual Care will not be held responsible for misrepresentation or omission of information by the patient or other parties.

4. Telehealth Limitations

America virtual care services have limitations. In some cases, the provider may recommend an in-person consultation for further evaluation. America Virtual Care is not a substitute for emergency medical services. If you are experiencing a medical emergency, please call 911 immediately.

5. Medical Information and Advice

All medical advice and care provided through America Virtual Care is based on the information you provide during your virtual consultation. You are responsible for ensuring that all information shared with healthcare providers is accurate and complete. Failure to provide accurate information may affect the quality of care you receive. 

6. Appointments and Cancellations

You can schedule, cancel, or reschedule appointments through our website or by contacting our support team. Please review our Cancellation Policy for details on cancellation fees and procedures. Failure to show up for a scheduled appointment or late cancellation may result in the non-refunding of the service fee paid.

7. Payment and Insurance

America Virtual Care accepts various forms of payment, including credit cards and insurance, once credentialing with insurers is completed. You are responsible for verifying whether your insurance covers the services you receive. America Virtual Care may collect co-pays, co-insurance, or full payments at the time of service.

  • Out-of-pocket payments: If insurance is not accepted or applicable, payment must be made directly through our payment platform.

  • Insurance billing: Once credentialed, America Virtual Care will bill your insurance provider directly, but you are responsible for any fees not covered by your insurance, such as deductibles, co-pays, or uncovered services.

8. Privacy and Security

America Virtual Care is committed to protecting your privacy and maintaining the confidentiality of your health information. We adhere to applicable healthcare privacy laws, including HIPAA. For details on how we collect, use, and protect your information, please refer to our Privacy Policy.

9. User Responsibilities

By using America Virtual Care services, you agree to:

  • Provide accurate and truthful information about your health and medical history.

  • Follow the healthcare provider's instructions and treatment plans.

  • Use the services only for lawful purposes and not for inappropriate or fraudulent activities.

  • Respect the privacy and confidentiality of other users and healthcare providers.

  • Misuse or attempt to exploit our services for unauthorized or illegal purposes.

  • Access or tamper with the accounts of other users.

  • Engage in any conduct that disrupts the operation or security of our services.
     

11. Disclaimers

America Virtual Care and its providers make no warranties or guarantees regarding the outcomes of any healthcare services provided. The services are provided "as is" and "as available," without warranties of any kind, either express or implied. America Virtual Care disclaims all liability for the quality or accuracy of healthcare services provided via telehealth.
 

12. Limitation of Liability

To the fullest extent permitted by law, America Virtual Care and its providers will not be liable for any direct, indirect, incidental, or consequential damages arising from the use of our services, including but not limited to, misdiagnosis, treatment outcomes, or delays in receiving care. You agree to use the services at your own risk.
 

13. Termination of Services

America Virtual Care reserves the right to terminate or suspend your access to our services at any time if we believe you have violated these Terms and Conditions or engaged in fraudulent or inappropriate behavior.
 

14. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the United States and the state of North Carolina, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the courts of the State of North Carolina.
 

15. Changes to Terms and Conditions

America Virtual Care may update these Terms and Conditions from time to time. Any changes will be posted on our website, and the revised terms will take effect immediately upon posting. Your continued use of the services after the changes constitutes your acceptance of the new terms.
